Primary liability insurance is usually required as part of a trucking license, because it protects people and property from damage caused by trucks. A primary insurance policy will only cover the damage to another vehicle or person in the event of an accident. The public is protected in this case. As a truck driver, you will need primary liability insurance in order to drive.
If you own or operate a trucking company, however, you’ll need to expand your trucking insurance to include general liability as well. General liability insurance offers additional protection in the case of a lawsuit or false advertising claim against your business. General liability insurance covers risks when you are not on the road. Physical damage insurance provides coverage for collisions that might cause damage to your vehicle. The other part of this insurance includes coverage for circumstances other than collisions, including fire, theft, vandalism, or damage due to other factors.
Every state has its own list of mandatory coverages and minimums, including the New Jersey Department of Transportation. According to New Jersey laws, it is mandatory to have minimum liability coverage of $750,000. This amount may vary if there are hazardous materials involved. In fact, it can rise up to $5,000,000. For something like oil, for example, it can go up to $1,000,000. In the state of New Jersey, liability insurance is mandatory, but you may require additional coverage in order to run a successful operation.
Trucking is not the same as driving around the city in a work van or other type of work vehicle. Truck drivers often haul large quantities of merchandise or business materials for extended periods of time. The Federal Motor Carrier Safety Administration (FMCSA – the governing body over the trucking industry) has certain minimum insurance requirements needed by business owners like yourself before your trucks can even hit the pavement for operation. A commercial auto policy will not suffice because, in the trucking world, there are different risks involved in daily operations. Under a commercial auto plan, truck drivers and/or trucking business owners would find themselves severely underinsured and not able to meet the minimum requirements for the FMCSA.
